Thank you for choosing DeedDesk. These Terms of Service and End-User License Agreement (the "Agreement") govern your access to and use of the DeedDesk website at www.deeddesk.in (the "Website"), including all content, functionality, and services offered through the Website, such as rental agreement drafting, e-stamping, and e-signing (collectively, the "Services"). This Agreement is a binding contract between you and DeedDesk.in ("Company," "we," or "us").

BY USING THE SERVICES AND ACCEPTING THESE TERMS, YOU (A) ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTAND THIS AGREEMENT; (B) REPRESENT AND WARRANT THAT YOU HAVE THE RIGHT, POWER, AND AUTHORITY TO ENTER INTO THIS AGREEMENT AND, IF ENTERING INTO THIS AGREEMENT ON BEHALF OF AN ORGANIZATION, THAT YOU HAVE THE LEGAL AUTHORITY TO BIND THAT ORGANIZATION; AND (C) ACCEPT THIS AGREEMENT AND AGREE THAT YOU ARE LEGALLY BOUND BY ITS TERMS AND THE TERMS OF OUR PRIVACY POLICY FOUND AT WWW.DEEDDESK.IN/PRIVACY-POLICY.

If you do not agree to the terms of this Agreement and our Privacy Policy, you are not granted any rights to use the Website or access the Services, and you must immediately discontinue use of the Website and the Services.

The Services and the Website are offered exclusively to users who are 18 years of age or older. This includes Indian residents as well as Non-Resident Indians (NRIs). If you do not meet these requirements, you must not access or use the Website or the Services.

1. Acceptance of Terms

By accessing or using DeedDesk, you agree to these Terms of Service and all applicable Indian laws and regulations. If you do not agree, please discontinue use immediately.

2. What DeedDesk Does

DeedDesk is a technology platform that helps landlords and tenants draft, e-stamp, and e-sign rental agreements online. We are not a law firm and do not provide any legal advice. Our platform simplifies a process, it does not replace a lawyer.

3. Your Responsibilities

As a user, you agree to:

  • Provide accurate, complete, and truthful information during document creation
  • Keep your account credentials confidential and secure
  • Ensure all parties to an agreement have knowingly consented to the digital process
  • Not use DeedDesk for any fraudulent, illegal, or misleading purpose

You are solely responsible for the accuracy of the information you submit.

4. E-Stamping and E-Signing

DeedDesk processes e-stamping through government-authorized channels. Applicable stamp duty varies by state and is the user's responsibility to verify and pay.

E-signatures are completed via Aadhaar OTP-based authentication, which is legally valid under the Information Technology Act, 2000. By proceeding, all signing parties consent to this method.

5. Payments and Refunds

All payments on DeedDesk are non-refundable once document processing has begun, as stamp duty and third-party processing fees are immediately incurred. If a transaction fails due to a platform error, we will investigate and resolve it within 5 business days.

6. Privacy

Your data is handled in accordance with our Privacy Policy. We collect only what is necessary to complete your document and do not sell your personal information to third parties.

7. Limitation of Liability

DeedDesk's liability is limited to the amount you paid for the specific transaction in dispute. We are not liable for indirect, incidental, or consequential damages, including losses arising from errors in information you provided or delays caused by third-party government systems.

8. Changes to These Terms

We may update these Terms from time to time. Continued use of DeedDesk after changes are posted constitutes your acceptance of the revised Terms. We will notify registered users of material changes via email.

9. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Coimbatore, Tamil Nadu.
